The Director General of Energy and Petroleum Regulatory Authority (EPRA) Daniel Kiptoo Bargoria has moved to the Court of Appeal to challenge a ruling on a multi-million shillings property belonging to his late father in Uasin Gishu county.

In the ruling delivered by Eldoret High Court on August 11, 2025, Justice Reuben Nyakundi issued restraining orders against the EPRA boss from interfering with the estate of the deceased, Barnabas Tuitoek Bargoria.

Kiptoo was also stopped by the court from further developing, disposing off, charging, transferring, subdividing or in any manner dealing with the land parcel Kiplombe/Kuinet Block 2.

Justice Nyakundi granted the injunction in favor of Kiptooโ€™s half-sister Loise Jerop Bargoria pending the determination of the succession case that is before his court.

The said property, measuring approximately 12.26 hectares of land, is at the centre of a bitter succession battle between Kiptoo and a section of his family members.

The late Bargoria died five years ago leaving behind two widows and seven children.

The deceased, who was former National Irrigation Board Managing Director, also left behind multi-billion shillingsโ€™ worth of estate spread in Nairobi, Uasin Gishu and Elgeyo Marakwet counties.

According to the petition, Kiptoo argues that the restraining orders in the High Courtโ€™s ruling means that he cannot access the property which he claims houses his family home.

Kiptoo further argues that he stands to suffer irreparable damage and prejudice if the orders he is seeking for are not granted since the judgement was undeserved.

He wants his application to be certified as extremely urgent and be heard on a priority basis and service to be dispensed with in the first instance.

Jerop in her supporting affidavit said that the deceased was her biological father who died intestate leaving behind a vast estate.

She states that the contested property, Kiplombe/Kuinet Block 2 (Rotich and Birech) 21 measuring approximately 12.26 hectares of land located along Eldoret-Ziwa road in Soy sub county forms part of their late fatherโ€™s multi-billion shillings estate.

She faulted his step brother for encroaching on the said property and undertaking mega investments projects in the said land without the consent of other family members.
